
All prices and payments are in GBP.
Payments must be made in FULL before I, the Artist, start the commission. Please be sure to have all required funds for your commission or the commission will be declined.
All orders are final, and refunds can only be requested if no work has begun on the project.
Maximum 5 free revisions of SKETCHES until submitted (not including linework or coloured process), complete reworks of the commission will cost the amount of the original work.
I will send you WIP (work in progress) sketches for you to approve before I move on to finalizing the piece.
I will not continue the work until each stage is approved, so if you take longer than 24 hours to approve the sketch, please understand that my completion time will also take longer.
Rush Order Fees:
If you have a deadline that needs to be met, please let me know beforehand to confirm if I can meet it. The rush order fees are an additional 40% of the total price.
Rush priority is only available if I can meet it, so please confirm with me first through the ticket or form if I can rush your commission.
Commissions are for personal use only unless otherwise stated. You cannot use my commissions for merchandise or resale. You may pay to have complete rights of the design for commercial use and resale.
Credits, Rights and Usage:
I retain original copyright and ownership of the Work, which includes but may not be limited to advertising, displaying the Work in my websites, social media and portfolios according to my discretion. I have rights to repurpose unused and used process work for future projects, personal or otherwise.
The process and images of the final Work will likely be posted on Twitter and/or streamed on Twitch unless Clients request otherwise before project begins.
Clients are granted exclusive rights for personal use and partial Commercial rights of the Work produced as agreed upon, which must not be transferred to any other parties. Personal use includes: Social media profile pictures, wallpapers, personal website display and social media posts that is not for sale or distribution to any other party.
Partial commercial rights include: usage on streams, broadcast content and any content derived from these (i.e. clips, compilations).
Clients may not at any time modify, edit, change the Work without permission from the Artist.
Unless discussed with me, the Client may not share the Work with others or use it under another name. This includes online aliases.
If you distribute the commissioned works without paying the Commercial Rights Fees in any manner outlined above, I reserve the right to decline future commissions.
Do not redistribute my work on any site without crediting me. Clients may not claim Work as their own or anyone else’s and therefore must credit me as the Artist using my social tag/username Nia Yume, NiaYume, NiaNoYume or any other variations. A link to at least one my social media pages (i.e. Twitter, Twitch) is also required.
Terms regarding NFTs & AI:
Any Work done or made available to the Client must not be used for or as promotion for NFT or any blockchain purposes. The client must also not create, own, or buy NFTs in the future.
Any Work and related media done or made available to the Client must not be used for the training of artificial intelligence.
Commercial Rights and Fees:
Unless specified in the commission information or otherwise discussed and agreed upon, full commercial licenses and reselling rights are not included. Full commercial means any monetized work including but not exclusive to: merchandise, videos not derived from broadcasted streams, music releases, games. It can be applied to all listings on the commissions page. Royalties are also an option and can be discussed. Reselling rights means selling the Work to another party or another platform. This includes giving the Work away for free or as a part of another Work (i.e. a Vtuber or VRchat avatar).
Original price + 2x price for artwork that is used as game assets, promotional uses, song covers etc (eg: emote costs: £40 —> £40 x 2 = £80; £80 + £40 = total £120)
Original price + 3x price for artwork that will be sold as merchandise ex: pillows, prints, keychains, etc (eg: emote costs: £40 —> £40 x 3 = £120; £120 + £40 = total £160)
Full commercial licenses may require additional charges on a case-by-case basis.
Timeline:
The completion of the Work requires 1 week at minimum, and may typically average 1 week to 1 month, depending on commission type, complexity, and workload of commissions. Deadlines and timelines will be adhered to in good faith but may not be possible sometimes. Note that each project may vary. Please plan your launches and streams accordingly.
There may be no major revisions for each item shown during the process, not including mistakes made by the Artist. Revision later in the process such as after model completion can only be minor. I will actively reach out for feedback.
Additional charge may be required for further revisions that may impact the progress and timeline of the project.
Delivery of finished Work will be through WeTransfer. Do note that WeTransfer requires you to download the file within a week of receiving the link.
Communication:
Communication will take place throughout the entire project timeline with updates and bouncing ideas. I will typically ask for feedback when I have something to show. I will let you know if anything is causing delays or priority shifts in the project.
I will use Tickets in my Discord channel to facilitate communications and track status updates on my Trello board. I will typically respond quickly but may also take up to 1 week, which is usually in order to provide a better, more concrete, update.
Clients agree to provide all required art, references, information and assets before Work starts and during the process, or it can affect the timeline.
I reserve the right to decline or request removal of any commission that I see fit or not in compliance with my terms.
By commissioning, you confirm you are at least 18 and above or have a legal parent/guardian to agree to all of the terms of service as listed above.
These are limits I have set so you know what I can and will draw.
